The Aam Aadmi Party-led Delhi government has given its nod to prosecute CPI leader and former JNU student union president Kanhaiya Kumar and 9 others in a 4-year-old sedition case. The development comes over a year after the Delhi Police filed the charge sheet in the court.
Reacting to the development Kanhaiya Kumar thanked the Delhi government and said that he wants a speedy trial in a fast-track court so that the entire country gets to know “how a law like sedition is being misused”. He alleged that the charge sheet was filed deliberately against him at a time when he was about to contest the election in Bihar.
AAP MLA and spokesperson Raghav Chadha said the Law Department of the Delhi government has given its opinion on this matter to the Home Department after due diligence. The sanction was granted by the Delhi government on February 20, he said.
“Thanks to the Delhi government for granting permission in the sedition case. Delhi Police and government officials are urged to take this case seriously, a speedy trial should take place in a fast track court and justice must be ensured in a court of law instead of a trial by media. Satyameva Jayate,” he tweeted.
Umar Khalid also tweeted his and Anirban Bhattacharya’s joint statement. “The news of the Delhi government granting sanction to sedition case against us doesn’t trouble us at all. We are confident of our innocence, have full faith in the judiciary and have ourselves been demanding the case against us to be tried in the courts”.
Filmmaker Anurag Kashyap, while attacking Kejriwal, wrote “Mahashay @ArvindKejriwal ji.. aap ko kya kahein .. spineless toh compliment hai .. aap to ho hi nahin .. AAP to hai hi nahin.”
P Chidambaram tweeted on Saturday and said, “The understanding of Delhi government is not less than the central government regarding the sedition law.” I strongly oppose the sanction of running a case of treason under section 124A and 120B of the Indian Penal Code (IPC) against Kanhaiya Kumar and others.
In February 2016 alleged anti-Indian slogans were raised in JNU when Kanhaiya was student union president which led to the national uproar after which he was put behind bars. A case was filed against Kanhaiya Kumar and others. On January 14, 2019, a charge sheet was filed in the court against 10 people including Kanhaiya Kumar, Umar Khalid, Anirban, Aqib Hussain, Mujib, Umar Gul, Basharat Ali and Khalid Basir, but the Delhi government did not allow the case to be prosecuted under treason.
The Delhi government had said at the time that the Delhi Police had violated the rules. A charge sheet has been filed without permission from them. Later the Delhi government had said that a legal opinion was being taken in this matter.
